Remote working and safety: what changes under the 2026 SME Act

New obligations for businesses regarding the management of remote working

smart working

In breve

Employers are required to provide, at least once a year, a written statement on the general and specific risks associated with remote working.
Failure to provide this information will result in significant penalties, including arrest and fines exceeding €7,000.

Why it is important to comply

Non-compliant management of remote working may result in:

  • Direct liability of the employer
  • Criminal and administrative penalties
  • Failure to cover specific risks
  • Problems in the event of inspections

Remote working requires a structured approach, not only organisational but also regulatory.

Remote working: a working method with specific risks

Agile working is characterised by the absence of constraints regarding location and working hours and by an objective-based organisation.

This flexibility entails a different risk profile compared to traditional working.

Key factors include:

  • Use of computer screens
  • Domestic or uncontrolled environments
  • Non-ergonomic workstations
  • Autonomous management of working hours

Written information: a central element

The legislation identifies written information as the primary tool for fulfilling safety obligations.

It must be:

  • Provided to the worker and the Health and Safety Representative
  • Updated at least once a year
  • Comprehensive, covering both general and specific risks
  • Consistent with the flexible working arrangements adopted

Penalty system

Failure to comply with this obligation results in:

  • Imprisonment for 2 to 4 months
  • Fines of up to €7,403.96

Penalties apply regardless of the size of the company.

A change in approach

The SME Act 2026 reinforces a fundamental principle:

remote working is not simply an extension of on-site work, but a mode that requires autonomous and structured risk management.

Addit’s consultancy approach

Addit does not limit itself to drafting the policy.

We analyse the organisation of agile working as a whole, verifying consistency between operational procedures, risk management and regulatory obligations.

We support businesses in building an effective security system even outside company premises, integrating regulations into organisational processes.

Structured management of remote working is not merely a compliance requirement, but a protective tool for both the company and its people.
